Welcome to Momentum! These Terms and Conditions ("Terms") govern your use of our web application ("Service") and specifically your subscription to our "Pro" plan. Please read them carefully.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
Momentum ("we", "us", "our") is a service provided by Alpine Sky Innovations Pty Ltd, located at Unit 1/5 Colony Close, Tuggerah, NSW, 2259.
Our Service redefines task management by helping you see where your energy is going. By organizing your tasks into life categories that you create, Momentum helps you visualize and maintain balance. Our smart prioritization system then guides you on what to do next.
We offer an enhanced version of the Service through our "Pro" subscription plan. While a basic version of Momentum may be available, the "Pro" plan unlocks unlimited use of the platform's features.
Your "Pro" subscription will begin with a free trial period of three (3) days. You will have full access to all "Pro" features during this trial.
You must provide a valid payment method to start the free trial. You will not be charged during the free trial period.
UNLESS YOU CANCEL BEFORE THE END OF THE FREE TRIAL PERIOD, YOU WILL BE AUTOMATICALLY CHARGED THE MONTHLY SUBSCRIPTION FEE.
You can cancel your free trial at any time from your account's billing settings. If you cancel during the trial period, your access will be reverted to the basic plan at the end of the trial period.
Upon the conclusion of your 3-day free trial, your payment method will be automatically charged $3.99 AUD on a recurring monthly basis.
This fee will be billed in advance on the first day of your billing cycle. Your subscription will automatically renew each month unless you cancel it.
Payments are processed by our third-party payment processors, RevenueCat and Stripe. Their respective terms of service may also apply to your payment.
You may cancel your "Pro" subscription at any time through your account's billing settings page. The cancellation will take effect at the end of your current paid billing period. You will continue to have access to "Pro" features until that date.
Subscription payments are non-refundable. We do not provide refunds or credits for any partial-month subscription periods or unused services. We may, at our sole discretion, offer a refund, discount, or other consideration in some circumstances.
We reserve the right to change the price of our "Pro" subscription. We will provide you with at least thirty (30) days' notice of any price changes by sending an email to the address associated with your account. Your continued use of the "Pro" subscription after the price change constitutes your agreement to pay the modified subscription fee.
When you create an account with us, you must provide information that is accurate, complete, and current. You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
The Service and its original content, features, and functionality are and will remain the exclusive property of Alpine Sky Innovations Pty Ltd. You retain all rights to any content you create or upload to the Service.
Your privacy is important to us. Our collection and use of personal information in connection with the Service is described in our Privacy Policy.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Alpine Sky Innovations Pty Ltd BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU IS LIMITED TO THE AMOUNT YOU PAID US, IF ANY, IN THE PAST 12 MONTHS.
These Terms shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
We reserve the right to modify or replace these Terms at any time. We will provide notice of material changes, either through the Service's user interface or in an email notification.
